Respected members,
Does final order of maintenance automatically cancels the interim maintenance order?
Also recovery of arrears amount from interim order is applicable after the final maintenance order?

The arrears of the maintenance amount needs to be paid till the disposal of the main case after which the order for maintenance stands disposed along with the main case

Final order passed in a maintenance case must have explained qua effective date of this order as well as arrears thereof.

Thank you for the reply Dr. Vashista.
No, nothing mentioned about the arrears in the final order. Only monthly maintenance amount to be paid from the date of the order is mentioned.

Please share case file with some other local lawyer for proper analyses of the judgment /order to form an opinion and advise.

No definite suggestion is possible unless the orders are perused and issues discussed.

Dear Venu Sir,
Nothing mentioned in the final order about the interim maintenance. Only final monthly alimony granted.

Respected members,
I've another query regarding this. As DV/maintenance case is over and marriage petition case still pending.
What if I don't attend the case?
Would court grant another alimony?
Do I have to pay both alimonies or the higher one?

The divorce case is a separate proceeding to that of the maintenance case.
The alimony is not automatic in the divorce case.
She has to file for alimony under proper provisions of law seeking alimony.
You may decide what is to be done i.e., whether to continue to appear in the divorce case or not, it is your own decision because we cannot advise you anything on it especially when you have already engaged an advocate, who will be able to guide you on all such further issues.
