can a private medical college can legally be asked to pay same salaries,perks,leave and facilities as given by govt. medical college in that state/central govt.esp. considering the latest judgement given by hon'high court delhi on 18 feb.09 in dr. gupta vs sunderlal hospital case where this pvt. hosp.is directed to pay same stipend to tainee doctors as given by govt. hospitals????

Even though citation qua stipend has been pronounced but it is not legally possible to have equal service benefits as are being granted in public sector contrary to agreement. If agreement contains any such condition then it is ok otherwise not possible.

If the medical college is receiving grants from UGC, then they have to pay salaries etc., as prescribed by UGC. A private medical college not receiving UGC grants need not follow government pay scale. Judgement of the Hon'ble High Court is regarding stipend to trainee doctors and not applicable in your case.

respected experts; the hon'high court given decision in cited case on the ground that both govt/pvt. hosp.are guided by same agency similerly both the college are controlled by medical council of india both having same critarion for all activities n same cariculum/// in this sinario whether a pvt. college can b permitted to exploit working doctors with less salary, perks n facility??? however i m GRATEFUL for quick help kindly been given by the experts...thanks..
