(Querist) 12 January 2015 This query is : Resolved
sir if the juvenile has committed offence under sec 376 & 366a at the age of 17 yrs and convicted at the age of 20 yrs, what sentence can be passed
ROHIT SHARMA (Expert) 13 January 2015
1. The Probation of Offenders Act, and Plea bargaining can rescue him from getting the maximum punishment provided for such crime. Since he was a juvenile when he had done this crime the quantum of punishment can be prayed to be decreased. This issue needs to be discussed in detail and your advocate could be of immense help.

2. In case you need to be briefed about how best such punishment can be reduced you can get my contact details by clicking my name shown in the L.H.S. margin of this reply format to fix an appointment with me.

3. Normally a very moderate sum for remuneration will be expected to be paid. Confirm this by posting e-mail on my e-mail i.d.

Court would consider the age of the accused while crime was committed, at the time of passing the order.
T. Kalaiselvan, Advocate Online (Expert) 17 January 2015
If tried under juvenile law, the punishment would be according to the said law only, you may consult your advocate for further issues.
