Forgery and cheating

(Querist) 23 June 2014 This query is : Resolved
Sir, i initiated a cheque bounce case and under trial.
i came to know the witness( accused's wife signature) signature( on the agreement on which i paid money )is forged by the accused.
the Second thing is, the accused has handed vehicle RC book (he told of his brother's vehicle)as security,and his brother has signed as guarantor on the above said agreement.
I checked with the RTO with respect to the RC book, wherein i found that the accused photo was attested and accused himself signed as his brother,(it is to say accused registered vehicle on non existence name and accused himself signed on the agreement and kept me in dark hence cheated)
shall i file separate case under cheating and forgery or shall i file police complaint,or shall i bring to the judge kind notice in the present cheque bounce case which is under trial.

You should file a FIR against such person apart from a civil suit and similarly you should move a complaint to RTO qua the fraud played with his department by the said person.
Advocate M.Bhadra (Expert) 23 June 2014
You can not file another case for the same cause of action,you can bring to the notice of the magistrate for forgery and cheating at the time of evidence of the present case.

@sankar narayanan!

You are agree with experts but with whom?

A am asking this question because there is are conflicting views of the experts on the topic so clarify with whom you are agree and why.
Sudhir Kumar, Advocate (Expert) 26 June 2014
you appear to have forged RC of a vehicle which belongs to someone else. the original owner can file criminal case against you. You will be more interested to get out of the same and will forget your loan.
