Rcr mediation

(Querist) 17 January 2014 This query is : Resolved
Re-opening the thread as it was marked as Resolved. As I am getting differences of opinion amongst the experts:

Background:

Hi Learned Members.

Applied for RCR, during the RCR mediation we arrived at MCD settlement, filed the MCD settlement on the same day which is Dec 04 2013, next date of the 13-B petition is June 07 2014.
RCR Case: My wife was supposed to file the Objections. I and my wife was present today. I and my Lawyer filed a memo to the court and brought the notice to the Judge that we have filed the 13-B petition with the case # and my advocate told that put the RCR matter to June 07 2014 and once the divorce is confirmed we will withdraw the RCR case. A copy of the MEMO was issued to the Wife and Wife's Advocate.
The reason why we did this is because my wife and in-laws are having the uncanny behaviour and change their mind any time. If we withdraw it now and if they withdraw 13-B petition we will be back to square one.

The Judge told that he cannot give such a long date but has given the date in March asked us to get one more date in March.
Am I going right in this matter. May be If my wife doesn't turn up for 13-B second motion I will any way have an option to withdraw by citing above reasons.
Is this technically permissible?

Hello Sir,

Please keep this thread open for others to comment their opinion, Legal fraternity has a difference of opinion let this go through them let them pour their opinion. Since you have already thrown light on this you can disregard it.

It is a practice here not to repeat the query on the same topic.
If you have anything to say then go back to your previous thread and post there but do not open a new thread.

Hello Ajay I never asked you to reply. Is this forum open for public or is this
Controlled by few advocates??

@Sandykrish, first let me opine about yur proceedings, it is fine to keep the RCR going that way, but basically RCR is not going to solve the issue, as it is you have decided to quit the married life with her and have consented to divorce her and both have filed a joint petition in this regard. What is the necessity for sailing with the RCR simultaneously?, how do you think it is going to solve any purpose even if she is withdrawing her consent in the second motion of MCD? In my opinion the parallel RCR is a mere waste of time.
Now coming to your angry retorts and behavior to other experts' opinions. Please note that the experts here spare their valuable time to contribute to the cause of the distressed and needy people, so let us be a little polite and not express our frustrations this way. The experts share their wisdom and express their valuable opinions/suggestions to resolve the burning problems of the querists who write here, so let us honor the selfless social service of all the experts.

Agree with T. Kalaiselvan. Every author should respect to one. Respect provide us a right path and anger show the wrong destination.
This is a public platform and authors are an important part of this body.

Mr.SandyKrish,

Mr.Barman had stated that it is a repeated query and suggested you to back to your original thread.

This suggestion is good for you. Because if you want further opinion from other experts, the experts will their opinion, only if they differ from others. Some times, the experts will say that they agree with the previous opinion.

However we can not prevent you from starting new thread on the same topic.
