I am a Central Gov. employee with more than 26 years experience. Can I give notice for Voluntary Retirement before 6 months of actual VR date ? (i.e. in March to retire in september). Whereas the min. period of notice was given as 3 months, Can an employee give -6- months notice in order to get prior approval & get the processing going on for pension, etc.. closure formalities ? What are the employer's options in such a case ?

Sir,
by "Actual VR date", I mean the date of last working day OR, the last day of the 3 months notice period on which, it is deemed to be accepted(in case of no reply from the competent authority).

When the notice period is specified for 6 months, the VR date cannot be six months prior to that date. That means you wish to give a notice in March asking the employer to consider your VR and relieve you in September? They will simply ignore your application. If they are so kind enough, they may keep it pending for considering after June. You can not be too alert by giving notice before hand and force the employer to consider your application to effect the VR at a later date. The employer may also grant VRS and ask you to get relieved at any time after 3 months. You have to follow the norms and rules of the management and you cannot have your own norms as per your wish. If you do so, you may land in troubles.
