a person purchesed a house on agreement of sale from A for a consideration of Rs.6,00,000.The person paid Rs.5,00,000 as an advance. A also GIVEN POESSESSION THE HOUSE to the person.Balance Rs.1,00,000 has to given on the date of Registration. Now A is refused to excute the Regd. sale Deed.If the person wants to file a case for Specific performence on the basis of agreement of sale what is the effect?Whether the person has to PAY penalty as the house is given poessession to the person by A.is there any impounding of the document.kindly advice.

the impounding of documents can be done if insufficent stamp duty is paid . in your case it was agreed between parties that on payment of balance considertaion deed of sale would be executed and document regd .
you have to issue legal notice to A mentioning that you are ready and willing to pay balance amount of rs 1 lakh and to request A to execute deed of sale immediatedly . on failure of A to do so take legal proceedings . contact a local lawyer
