Property vs gift deed

(Querist) 22 March 2012 This query is : Resolved 
My Grandfather has four sons (My father and three uncles). My GF was sole heir of my great GF. At the time of my GF’s passing, he has made a Gift deed in favor of one of my uncle’s son of an ancestral property, excluding all his sons from the property; it is not self-acquired by GF. We are Hindu and lives in Gujarat, India. You should have clear picture now, one of my uncle is not in favor of challenging since his son is getting everything. Do we have any rights of our share (My father and two uncles) in this property?

My uncle whos son is getting the benefits now saying that my Great GF has left the property on name of my GF, so this is his (GF) personal property; but he is not willing to show the document.

you claim your share in the share of your father in the properties then everything will be settled.

You should challenge the gift and partion suit will be filed. You will get your share. The gift will be declared invalid by the court of law.
