Hi Experts, I wanted to clarify a doubt regarding my recent dispute with my home loan provider.I have take a loan for 20yrs and paid the EMI for 1yr. i got a call from a person stating that he is from the bank and i have some extra dues to be paid as the ROI of home loan is increased. i was not informed abt this for 3months and for that they said they were sending letters to my old address.i went to the bank and they explained the same and asked me to sign a new ECS form to deduct the increased EMI according to present ROI. they said till i sign that they cant process the ECS for the new EMI. however this month they have tried taking the New Increased EMI from my account, which bounced as i kept only the required fund which i was paying a old EMI. Is this activity of Illegal thats trying to take unsigned ECS amount ?? Also they have called my family members and spoke like threatning..Can i go for a legal action for this action of the bank ?? Is yes what the right way to proceed. Thanks

if your address has changed it is your duty to inform the new address . your agreement must be containning a clause that adress of borrower for service of letters , notce is the old address.
bank has intimated at your old adress that EMI has increased on account of rising interest rate scenario.
pay the increased EMI . your property is mortgaged to the bank

Forgot to mention that i have updated the bank with my new address since the date i came to my new residence and all the other letters from them has been reached me such as Loan break ups,ECS date change. The reason bank said for sending the letters to old address is becoz they had a internal change within their organization and they lost my details....
