cooperative housing societies up

can a society change its layout plan once it has already executed 60% registered sale deeds as per approved plan but due to problems final agreement could not be done & now after 27 years arbitrator cancels the sale deed saying i was present in the general body meeting in which plan was changed.we kept paying development money and were assured we will get full land

Dear Upendra,

I all depends upon availability of land, feasibility, funding position, expenditure control and more on the approved resolution by the executive and general body.

However, if you have ample proof contrary to the arbitrator's award, you can challenge the award in the competent court of law.

thanks for the info mr dhingra & ms uma.my basic problem is that my father was founder member and paid 4500/- in 1965, cost of plot for 828 sq yds. now society says take 200 yds plot since layout changed due to govt orders. isnot there high court ruling on such change in plan & compensation for the victim.
