(Querist) 28 April 2010 This query is : Resolved 
under what provision of law a co. whose employee died during course of business. liable to pay comensation where no t.u. formed.
how much compensation normally given by the co if person died during course of business worked 2-3 years, salary 3500/- excluding p.f.
the jurisdiction of which court applied in theese cases if died outside delhi office but working in Delhi

Petition under Workman compensation act is payable in such cases wherein the age of the deceased at the time of his death, his last salary, other service benefits are taken consideration. There is no role of trade union in such matters.

Generally 15 days salary per month till the retirement age is liable to be paid to the legal heirs of such deceased employee.

If he was covered by ESI, the compensation has to be sought from ESI. If ESI scheme was not there, then Workmen's compensation Act is there. The amount of compensation is fixed in the schedule of the Act and the amount depends upon the age of the workman and his last drawn wages. The death must have occured while working on duty and the death has not caused due to negligence of the workman.
