dear u ve not mentioned whether the employee is central govt. employee or state govt. employee.

u should ve a look at the relevant notifications and policies in this context.

if u dont ve those then consult some local lawyer and using those documents send a necessary legal notice to the concerned department first....if no action is taken then take legal action as required.riven
