Settlement of account/dues.

Hello sir,
I have purchased a flat measuring 1367sft. while purchasing it was clearly mentioned and shown in the layout plan that the flat will be having 2 balconies one each attached to Master Bed Room & Living Room.
later on verification of sanctioned plan, no provision is made for living room balcony.
Now that the builder is sending letters for early settlement of dues, your kind clarification is sought on following points :

NOC from fire dept is pending,
Occupation Certificate from BBMP is also pending,
unless NOC from fire dept is received, application cannot be filed with BBMP for OC.
when the balcony itself is not provided as indicated in the plan, part of the building is still pending, the question of making payment does not arise. and moreover still several works like providing gymnasium, club house, children play area, allotment of car parking, STP, etc are pending, how can the builder press for releasing of payment including VAT.

it depends upon terms and conditions of agreement . if the agreement provides that on basis of slab wise construction payment is to be made then you have to make payment as mentioned in the said clauses . failure to pay would result in builder levying interest . you cna address letters poing out to builder that following amenities have not yet been provided till date ,ask him to providde bar chart when OC will be grnated when cub house etc will be constructed
