Dear,Experts,
A wife has been awarded monthly Rs.2000/-maintenance from her husband by the court in 2010.now she wants to to file a petition for recovery of all the arrears.But her lawyer saying that only for the last 11 months she can claim.For the balance arrears wife has to file a civil case for recovery.Is it true.kindly advice in this regard.Any Citations in this regard most welcome.THANK YOU.

Dear Mam,

She may file a money suit in the Civil Court or she may even file an application in the Family Court and claim her arrears.

she can claim last three years arrears. she will file a suit for recovery of money based on the judgement of maintenance, if the court declared judgment in favour of her, further she can file ep for attachment
