Suspension of a chargesheeted govt.employee

Sir
CMD (non IAS)of a semi Govt. organisation is chargesheeted by police under section 420/467/468/471/524/506 IPC.Can he be suspended by the parent organisation/board of directors?

Dear Asthana,

Please clarify, what do you mean by parent organisation? Do you mean to say that the CMD was posted in the semi-Government organisation on deputation basis as belonging to some other Government organisation?

It is not mandatory to suspend the employee, if he is facing a criminal prosecution.

In most cases the service conditions provide for suspension of an employee if he is facing criminal charges. Moreover if the charges 420/406/468/471 IPC stem from the job he is doing, suspension is justified.

Mr. Ali if you want to use this reply make sure that even this is in proper grammar.

Suspension is neither a must nor justified just on filing of chargesheet.

It would lead to absurdity if all people who chargesheeted are suspended.
