THE ISSUE FRAMED IS OF CHILD WELFARE.

CAN THE MOTHER AS OF RIGHT SUCCEED IN LIGHT OF THE FACT THAT SINCE AGE OF 3 YEARS TO 5 YEARS THE CHILD WAS AND IS WELL MAINTAINED BY THE FATHER .

In cases if children below the age of 5 the custody is ordinarily given to the mother but if the welfare lies with the father then, the custody may be given to the father.
