rights of heir

(Querist) 12 April 2010 This query is : Resolved 
My father died leaving hehind flat.No will,nomination prepared by my father.So we obtained hiership from court on my mothers name. Society transfered flat on my mothers name.Now my question is can my mother sell or gift flat to anybody. What are the rights of heir as she is the only trustee of the property.

Mother alongwith other heirs can sell the property. All heirs are equal sharer.
