practice as ca & advocate simultaneously

SIR,

KINDLY GIVE ME GUIDANCE ON BELOW:

1) CAN I PRACTICE AS ADVOCATE & CA AT THE SAME TIME?

WHAT CAN I DO FOR GETTING APPROVAL OF THE COUNCIL OF THE INSTITUTE OF LAWYER TO GET PERMISSION OF SUCH PRACTICE?

You can do so as both are practices and even advocates doing taxation side advocacy perform the same job.

So far as permission is concerned, it is no where required in the given case.

In my opinion one can pratice as a lawyer or pratice as a chartered accountant.If one is qualified as both. I would prefer one pratice as a lawyer. Take the example OF LEGENDARY NANI PALKHIVALA HE WAS QUALIFIED AS A CA AND LEGAL GRADUATE YET HE PREFERRED TO PRATICE AS A LAWYER ON TAXATION SIDE.

Two practices cannot go together and also not permissible under law.

Both the ICAI and BCI do not permit their members to practice two professions at a time. IF a practising CA who is also a qualfied lawyer wants to enroll himself as an Advocate with the state bar council to start practise as an Advocate, he has to surrender his certificate of practice with the ICAI and give up the practice as CA. I know many past CAs who have surrendered their practice as CA and now are practising as an Advocate. Taking up two professions at a time is also a professional misconduct under Chartered Accountants Act and the regulations thereto.

No. two practised is not permissible at the same time. its further to be add thatIt is also not permissible for a Member of ICAI who is practicing as an Advocate, to use CA Logo on his professional stationary as the CA Logo is recognized as a symbol of CA Profession in India and it is to promote the brand of Profession of Chartered Accountants
