Sir,
After completed 10 years of regular service in DEPARTMENT OF POSTS I reigned from service and joined to KENDRIYA VIDYALAYA SANGATHAN an Autonomous body under govt of India.
I have been granted pro rata pension from postal department under rule 37(Absorption Pension) .
I have applied for pay protection but the same was rejected on the ground that I have granted pro rata pension from my previous department.
Kindly clarify the rule position whether I am eligible for pay protection?

Did you seek permission of postal department before applying to KVS and KVS accepted?

Yes sir I applied through proper channel and tender my resignation in postal department to join in KVS .KVS allow me to join after relieving order from Postal department.

Dear Sir,
You are entitled for either of two options so in my considered opinion you may not get both the reliefs. Anyway check and try to approach High Court or Service Tribunal as the case may be and try to get appropriate relief.
