SIR/MADAM I WANT TO KNOW THAT IN ACCIDENT CASE WHETHER BIKE (INSURED WITH A INSURANCE COMPANY)HAS STRUCK A PERSON AND HE INJURED THIS ACCIDENT. IT IS POSSIBLE THAT HE CLAIM AGAINST THAT INSURANCE COMPANY.
Adv Archana Deshmukh (Expert) 08 December 2009
Yes, he can claim. Make the owner of the bike and the insurance company as opponants in the claim petition.

thanx madam. But also this i mean of this qurrey, is it possible that he get compensation from insurance company separately
Adv Archana Deshmukh (Expert) 08 December 2009
You have to make the owner of the vehicle a party(opponant) in the petition. The liability of the owner to pay compensation, is discharged by the insurance company because of the policy contract with the owner. The owner of the vehicle is a necessary party in a motor accident claim petition.
RAKHI BUDHIRAJA ADVOCATE (Expert) 09 December 2009
yes, as per law the driver of the vehicle, owner of the vehicle and the insurance company,if the vehicle is insured are liable to be party in the claim case.
