Presumption and reality

(Querist) 03 September 2014 This query is : Resolved 
A person presumes that a part / one of his properties taken over by Govt. due to land acquisition consequent to ceiling act and writes a will to this effect and expired. In reality it is not taken over. Can the beneficiary of the will claim it? the will says if anything left out in the will it should go to beneficiary. Would it be consideed as disowned property, though in reality it belonged to the deceased.
