Soil of earth whether taxable or not

we have purchase 3 lorry load of soil of earth for filling the factory land from some unregistered dealer. now the sales tax authority ask for unregistered purchase tax from us.

please tell me is the soil of earth taxable or not? if taxable then what the percentage under west Bengal value added tax act?

please advice.

As per my knowledge, the same is not taxable as on day.

Earth evacuation, alike other minerals, sand, metal, implies payment of royalty and other local taxes, which has to be paid at point of origin /loading.

This cannot be avoided and is punishable with Fine /Panalty /Imprisonment.
