If an Indian residing in USA as American citizen visits India frequently taking videos and pictures of poor & needy children in order to make fund from USA for his personal enjoyment, what type of legal action can take on him?

Mere takking of photo is no offence unless you could prove that the same is used for pornography.
It is no offence.
