Hell experts, please advice me in following case
My father had made agreement to sell an agriculture land which was unregistered, 2.5 years back. The agreement specifically says that if the sale deed not executed within particular time the agreement would stand cancelled and the purchaser will not get the right to litigate for specific performance in any court. Also at my father side there is no any type of contractual default. The purchaser failed to pay the consideration. We have given legal notice to the purchaser for the cancellation of agreement. He has also given the notice that he was supposed to ready for the performance of the contract. Till today, he has not filed the litigation in court.
My query is that
1].The title of our land is in dispute?
2] If we gives the advertisement for title clearance, can we get valid title clearance certificate?
3] As per law he has to litigate us within 3 years from the date of cancellation mentioned in the agreement, can we get valid title after 3 years?

Till no sale is effected and registered, title will not be effected. No need to give Advt etc. From where you want to get the title clearance certificate is not clear?

I am leaving nearby Ahmedabad.
so i need not to worry about title clearance,isn't it?
