One person of my family has not taken bail in dowry case.
Now he has gone for quash.
How can trial start for other persons leaving that one person trial?
Hukum Singh (Querist) 08 June 2013
Waiting for experts reply.
Adv Archana Deshmukh (Expert) 08 June 2013
If there is no specific order of seperate trial then, the court cannot leave him aside and continue trial with the rest of the accused.
Rajendra K Goyal (Expert) 10 June 2013
Agreed with Expert Adv. Archana Ji.
Hukum Singh (Querist) 11 June 2013
My lawyer said until and unless all accused not take bail.
Framing of charges can not happen.
How true is it?
V R SHROFF (Expert) 11 June 2013
Normally, COURT CANNOT START TRIAL unless all accused are present in courtroom.
So it is true. Framing of charges is part of trial
