120 b ipc

(Querist) 28 July 2012 This query is : Resolved 
we are booked under 120 b for the mistake done by process server of the court.

i want to ask, whether the court can presume us to be benifited for such act of the process server and book us under 120 b ipc together with other offences applied to process server?

please cite relevant judgments so that i can effectively argue my case.
