HI I WANT YOUR HELP
Q. I BOOKED A FLAT IN BHIWADI ( RAJASTAN ) OF A BUILDER. HAVING CORPORATE OFFICE IN IN GURGAON NOW I HAVE A DISPUTE WITH THE BUILDER FOR MY FLAT IN BHIWADI, CAN I FILE A CIVIL SUIT IN GURGAON COURTS. ALSO IN THERE APPLICATION FORM IT IS WRITTEN IN CASE OF ANY DISPUTES IN BHIWADI OR DELHI COURTS ONLY

then you ahve to file in Delhi or bhiwadi only . not in gurgaon .

I have already filed in gurgaon. As course of action took place in gurgaon only .Newspaper advertisement also said to contact the gurgaon sales office at time of booking and still if I can’t go ahead in gurgaon courts. Can I get the same rights of the case when I filled the case in Gurgaon for permanent injunction, if transferred to Delhi?

you had agrred to be subject to jurisdiction of courts at delho ir bhiwadi .

in reply if defendant raises the issues then suit would be retruned and you will hvae to file in delhi or bhiwadi

Sir I totally agree with this but my question is will my case be on same status in Delhi courts as when filed in gurgaon court or it would be a totally new begging

Help wanted from learned advocates.
I have booked a property in Bhiwadi Rajasthan, and there is a dispute with the builder, I have only singed a booking form which says only BHiwadi or Delhi courts have Jurisdiction. So i have filed a case of permanent Injunction, Civil case in Delhi Courts, now the company lawyer is challenging the Jurisdiction. In reply my lawyer has told the court that a relief can be obtained under section 16 CPC (16 D and O.VII R-11 of CPC) on personal obedience.
Please Help me out are we going on the right track to get the relief from the court
