dear expert
my father and mother jointaly filed a case befor the consumer redressal forum against the builder in c.S.t Mubai for shrot area and delay posseson in 2005 my father had been expired and in 2010 we file applicatioon for legal heir to be on record we total 4 sister and 1 brother on e sis married and application were allowed final partly order was allowed in our favour actually order was exparte order now builder move on to appeal in dealhi national commission we received the appleal memo builder sent 2 set of appeal on in my mother name and other all legal heir now we drafted an affidavit in reply affidavit is executed by my mother for her and our behalf mu confusion is that as affidavit is executed by my mother so it is necessary to my mother should br present personally befor natioanl commission delhi my mother has back problem and sje canf suffer such a long distance from mumbai to delhi we alredy sent the one et of affidavit in reply against the appeal memo to the builder and alredy notarised the same affiadvit in mumbai pls solve my query persoanl attendence of my mother is compulsory to file affiadavit or we leagl heir can file the same .

Your mother is not required to appear personally before National Commission, New Delhi, for filing her affidavit.Attested affidavit may be sent by post from your residence.

Your mother need not to appear personally, she may file affidavit through her attorney, husband or Registered/ Speed post
