Rejection of issue framed

Issue has been framed by the court in divorce matter. After one year of issue framing, evidence not yet started due to various I.As. applied by both the parties, respondent has applied for rejection of the application questioning legality of issues framed. Can family court reject application without evidence? Whether such rejection application is admissible?

its can be rejected.. framing issues are duty of court., if you have merits mean you have to challenge that issue rather than questioning about it's legality..
