Resp Sir,-New “Provisional Committee” was formed(Nominated)on 22-04 still no official announcement of portfolio’s by them as yet.(1)It is learnt that- Chairman has resigned recently. Whether Society can exists?(2)One who claims to be secretary-is not Eligible for office bearer as he is not the owner of the flat.(Flat is in the name of his wife)What is remedy to expel him out? He is not ready to go.(3) Two other members are also not owners hence they can not be in the society’s Body??(4)Two members have resigned and in their place 2 new members are taken by the provisional committee. Whether it is Ok.(5) Now Promoter(Builder) is pressing & ready to talk to the society only if certain members are removed from the Provisional Committee. He was present on 22-04 when these members were nominated. Whether it is Ok.(6) What action do you propose that should be taken to overcome this problem.

to be a mmber of managing committee it is necessary that you should be a member / associate member . in present case if flat is not owned by Secretary he cannot be elected to managing Committee . similarly if other members are not owners of flats how can they be elected to Managing committee .
all members of society should get together and call for freh meeting of all members of society to elect a new managing committee
