Flat given on leave & license basis

Respected Sirs,

During December 2011, I have given my 2BHK Flat in mumbai on Leave & License basis for a period of 24 months at a monthly rent of Rs.19000/-. The agreement has been duly stamped and registered with the authority. The copy of agreement has also been given to the local Police Station for Police Verification.

The Licensee has given me a 12 post dated cheques for first year rent. First two cheques for the month of December 2011 & January 2012 has been honoured. Thereafter, Licensee has requested me to wait for sometime for the deposit of other cheques. Unfortunately, he Licensee has not paid me a rent from February 2012 to May 2012 i.e. for 4 months. In spite of his commitments to vacant the Flat by Mid of May, now he neither have any willing to vacant the flat nor he has any desire to pay the rent. I have a deposit of Rs.1 Lac from the Licensee.

What legal alternative is available to me to get my flat vacanted. Shall I lodged a police complaint? shall I disconnect electricity supply to the said flat? shall I instruct the builder/society to not to enter the Licensee in the premises?

I am under tremendous pressure due to above mentioned fact.

Your advise in the matter will be highly appreciated.

ssiue legal notice to licence to vacate the premises . what are clauses in agreement for default in payment?

if licence refuses to bvacate the premises you will have to move before competent authroity to obtain vacant posession .

you cnanot disconnect electricity supply . if agreement contains clause as to interest you cna recover interest on outstanding duies . in addition you cna file complaint for cheque bouncing
