(Querist) 09 May 2012 This query is : Resolved
Hello Sir/Madam

My father have got a tenant against whom suit of eviction have been filed. He left our house but still kept the flat under lock and key. In other hand they have filed a case under Section 68 of the Code of Criminal Procedure accusing me, my father and mother under a charge u/s 341, 506, 504 and 430 I.P.C. In the other hand my husband got a job in Tanzania and he have been offered a lucrative job with family accomodation. My question is that can I move with my husband in this situation? My father have hired lawyers and it is still under process. Please help me what can I do in this situation? I stay with my husband in another flat now but they have accused me that I am staying in my father's house. Please advice.

Dear Dipa,

Having faith in the battery of lawyers hired by your father. We don't what case is all about, what are the facts, what stage it is at present. Hard to comment without all these

Answer these questions :-

1. Are you on Bail ? If Yes any conditions like surrender of passport or not to move out without court's permission ?
2. Has the trial started ?
3. Charges Framed ?
4. Have you tried going to HC u/s 482 ?

Sir

There I submitted a bond and there was no such clause. Trial started. I have no idea whether charges are framed or not. I have not tried anything for HC. Can you help me that what it is?

Thanx

You can travel as long as you attend court dates or file exemption application on every date.
