Esi query.

Respected members,
thanks in advance for sharing your precious time.I would be obliged if you answer my below query.
"if an employee is working at a place different from the place from where his appointment letter is issued and where ESI Act is not applicable due to the fact workmen compensation act is applicable there(his present place of work)but his employment letter is issued from the Company's head office at Gurgaon and his salary is also disbursed from head office.what would be the case if employee met with an accident at his present place of work, can he still be covered under ESI act. In other words whether place of employment is linked with availing ESI benefits. whether he can still be covered under ESI act because his employment letter is issued from the place where ESI act is applicable. What would be the legal position.

is he or is he not employee of the company where there are 10 and above employees.
