Scale of pay

Workers presently receiving consolidated monthly wages. they are working for 30 years and more. they are permanent workers. but they do not have any pay scale. whether they can claim for a scale-of-pay ?

Dear Raja,

A running pay scale or consolidated monthly wages is the prerogative of the employer. An employee cannot legally claim the scale as a matter of right unless mutually agreed on negotiation basis by the employer-employees for the whole class of employees.

If consolidated salary is not less than the scaled pay then there is no use to demand pay scale. It is seen that many institutions provide more wages in consolidated shape then in pay scale.

It is the prerogative of the management to provide pay scale or consolidated wages. Workers though may be working since last more than 30 years have no right to claim pay scale as a matter of legal right.

Trade Union can put up a demand. As opined by the experts Sri Dingra and Sri raj kumar makkad, even though the employees are working for more than 30 years, can not claim pay scale as a matter of their right.

Definitely, the item, as of common interest of the employees, can be taken up with the management through the trade union.
