Judgment on bail

Querist : Anonymous (Querist) 17 August 2011 This query is : Resolved
Sir, Can u help me to find out the following judgement as it needed urgently.

there is judgment on the point that if the accused is otherwise entitled for bail, he can not be refused on the ground that he belongs to other state other than the state, where offence is registered.

thanx in advance.

Normally courts ask for local surity in such cases, otherwise if entitled bail can not be denied.

Bail can not be claim as a right, it is discretion of the court.

For an offence which is non bailable it is judicial discretion of court that governs the bail application.

Bail is right and jail is exception this is the general trend of higher court decisons.

This persons problem is real regarding other state status of the accused.

Well I am posting here a recent judgement of SC which I have also posted in files section and more than thousand persons have downloaded it.

The citation is for Anticipatory bail but gives guidance for bail and may be helpful.
Dr Anil Kumar Singh (Expert) 17 August 2011
As per CrPC bail can not be claimed as right but in ordinary circumstances the court shall not deny the bail without proper grounds. There is no provision that bail can be denied on the grounds of State , it can only direct for local sureties of sufficient amount. All experts are correct
