Transfer of Flat in my name

I bought a flat in a Co-Op Hsg Soc in Mar2011. We have executed the registration
after paying stamp duty etc from the registrar's office. But now Society is not
ready to transfer the Flat in my Name. Because the original Sale Agreement between
builder and first buyer and Chain of link agreement is lost. i am the 6th
Buyerof the flat. and i have only 2 registration documents. How will i get
share certificate in my name.
And what are the consequences if the society doesnot transfer the same.
Can i Take the possession and reside in that flat?

if you have servey no. and approval no. then document, then get certificate copy of the document concern department. thereafter you will register,or you will made police complaint regarding aforesaid missed document and file fir then get from register office duplicate copy

Usually at the time of registration its will be filed along with the mutation application. Now thats missing in your case. Its ok. Now you file a petition for change the name of patta in your name with sufficient proofs.

a patta is akin to lease like where ownership rights are limited to possession and as time passes law graduates the original rights conferred.

First inspect records,take the note of details of documents and then apply for certified copies.

You appoint an Advocate to take search of this property as you have a property details in the sale deed executed in Mar 2011. The Advocate will take search of this property 20-30 years back from this current year. He will write all details of transaction alongwith date and years and document numbers. After knowing these various documents nos., you apply for certified copies from Registrar Office by paying their requisite fee. After receiving certified copies, you make sequence yearwise and make a chain of transfer of this property and handover to the society. It is the duty of society also to keep record updated from time to time.

1)when you bought flat from seller did you obtain NOC from society
2) if you have furnished copy of agreement entered into between you and last seller to society along with transfer charges society is required to transfer flat in your name
3) when you bought the flat did you not check with the seller whether he had all origginal set of documents .
4) has the society given in writing the reasons for not transferring flat in your name .
5) if not ask them to give in writing .
6) then lodge complaint with asst registrar of cooperative society regarding failure of society to transfer flat in your name

no, i didn't obtain NOC from the society thats my big mistake
society doesnot have the first registration doc beteen builder and first owner. they ant that doc. pls help me so that i solve the case m and not by fightingutually
