Dear All,

what is the value of a notorized document?

is it binding on the signing and executing parties?

what is the evidentiary value of the same?

can we issue NOC for transfering the property in which we have right, by merely executing consent letter and notorizing same.? is it binding on us?

a document which is duly signed in front of notary public has evidentary value . the fact taht document has been signed in front of notary indicates that you have signed document out of your free will .

i presume that transfer of property is for consideration . for transfer of property it is advisable that agreement for sale be executed and said agreement be duly stamped and registered .

An immovable property cannot be transferred by mere notorisation.
It requires to be compulsorily registered. For registration one has to pay the necessary stamp duty and applicable registration charges. Anything short of this will not validate the transfer of the immovable property.
