PF Withdrawal & PF Pension

Querist : Anonymous (Querist) 28 June 2011 This query is : Resolved
Dear Sir,

If an employee has given his father's name in PF nomination form as his nominee and gets married later. In case of his death who will be entitled for getting his pf accumulation and pension from PF, his father or his wife?
Guest (Expert) 28 June 2011
Pension is not paid from PF, it is paid out of a separately credited pension fund. So, the PF part can be paid to the nominee, while pension will be admissible to the legal hier, i.e., his wife.

If father has been shown as nominee in the PF Account, the amount will be paid to the father. But the father cannot use the amount himself. He has to distribute the same amongst the legal heirs of the deceased person. The legal heirs of the male person are: son, daughter, widow, mother etc.
Father is not even a Class-I heir. Only when the above legal heirs are not present, then the turn of the Father will come, otherwise not.
The wife should write to the organization concerned. Then they will insist on the "Succession Certificate". Where the Father has to definitely show the legal heirs. Once the legal heirs are shown, the Organization will be careful enough to ensure that the money is given to the legal heirs.
