doubt in divorce case filing

namaste sir,
my case is divorce case in a district court khammam,ap.
i given required documents to my advocate in dec 2010 for filing divorce case, in feb 2011 he told that' case filed, notice issued by the court to my wife and trials will star from march 2011"., after few days he told march 18 trail over but no need of my presence in concerned court. nex trail on 25 april, i went to the concerned court and waited for my name upto 12.30 , at that time my advocate came out and told i managed with judge and your next trail will be on june 11, but no need to come , and i can manage. but from june 11 my advocate is not telling my next trail date. then to clear my doubt i went to court and asked clerk , he is telling upto today not called your name and in court dairy also your case is not there. now i shocked and my doubt is without numbering case is it possible to go trials in court? now my lawyer is telling on some case files judge is not signing, in that your case file also, it take 2 more months to sign, then will give your number. my case is in district court sir. is it true sir, now what steps i have to take sir?

It seems that your advocate is not at filed your case.
You better check the case register, where you will get the case number. Then you ask your lawyer.

and what are the docments or copies i have to take from advocate in my case?
what document copies to produce for complaint on advocate to state bar council sir ?

i am sorry and i doubt your case has not been filed.
to become sure visit court again check or get checked by some one else institution register of court.
engage some one of repute 2 file a fresh divorce case.
your previous lawyer is guilty of misconduct,and u can lodge a complaint in state bar council against him or act as your newly engaged but a reputed one advises you.

what document copies to produce for complaint on advocate to state bar council sir ?
ans; just state all facts as they have proceeded,i do not guess u have any document of proof against him,if any , enclose along with.

you collect back your papers and expenses from that lawyer and find another reputed lawyer and file your case. from you query it is clear that no such case has been filed yet and no court in India take such a long time in giving the filling no.

Ask your Advocate to give you BIll mentioning Case No. and all dates, Thereafter you get it verified in court, real picture will come out.Thereafter you lodge a complaint with the Bar Council of the State.

Normally Its usual practice, clients too have to be vigil with his advocates . Advocate is contesting the case under your instructions and you also remain vigil and later you cannot botched up with his plea that your counsel has misguided you
Advocate may be right as he is piled with other cases too. Its better to consult the listing cell and check the date on which last date fall and where you get the clue for next date of hearing
Alternatively you can file the certify copy of daily order passed and you can know about the status of the case
or make the help of RTI and made an application to the Registrar for collecting necessarily information
While I can understand that your advocate has filed the case in Feb 2011 and notices issued to your wife and there may be the possibility of adjournments on 18, 25 th April and you were told on 11th June 2011 that your name was not listed in the cause list. Its better to file the certify copies of the order passed on 18th March, 25th April and there you will get the status of your case
