Power of attorney

Querist : Anonymous (Querist) 27 April 2011 This query is : Resolved
Can a Power of Attorney holder of Vendors execute a sale-deed in his own name ?
If yes, are there any authorities suggesting that the said act is illegal ?
Devajyoti Barman (Expert) 27 April 2011
Yes he can as the person holding the POA is different from the person who is purchasing the property.
A same person may have different capacities and perform different acts in such different capacities.
If he does anything in his official capacity then does that as PERSONA DESIGNATA who s different from the person when he represents himself in his private capacity.
Naresh Kudal (Expert) 27 April 2011
agree with expert Mr. Barman.
