regarding vakalat

Good afternoon,

I am a junior (2010 batch) can a junior be an independent advocate .Do the court has any objection or any seniority required for a junior advocate for filing, handling a case individually.If so, Senior advocates signatures is necessary in vakalat . please, send me reply .

Any one, who has enrolled himself/herself as an Advocate with the Bar Council can have the vakalatnama in his name. Even immediately after getting the Bar Council enrolment number, one can file a vakalatnama in his name. Thus, there is no objection from any quarter, much less from the Court, for vakalatnama in the junior advocate's favour.
Having said this, if you are working under a senior, then normally the vakalatnama will be in the name of the senior and you being his junior would also be included in the vakalatnama. It is always advisable to consult and get it clarified from your senior in these matters, since while being a junior to a senior, if you try to get a separate vakalatnama in your name, probably the senior may mistake and/or object. It depends upon your arrnagement / understanding that you have with the senior.

You can practice independently, no permission is required by anybody. But for the experience senior is necessary.

You need not work under a senior. But, working under a senior will give experience. without experience it will be difficult to handle your client's cases.

in the legal way there is noobjection but in prectical when a junior argu in henious matter then court may ask to take help of a senior lawyer!

however in district court there is no designation of senior lawyer!
all are lawyer!
senior lawyer comes highcourt n supreme court ,and they don't sign. on vakalatna!
