Validity of conditional will

Querist : Anonymous (Querist) 21 March 2011 This query is : Resolved 

"A" have certain landed properties by partition deed (Ancestral property)and he bequeathed his share (which is allotted by oral partition) to W, D with absolute right after his demise and he also imposed a condition if they desire to sell the property they must dicuss with "X" and follow his advice.

1. If "W" and "D" sell the property without discuss with "X" what is the validity of the said SALE.

Being the absolute owners of the willed property, non-consultation with 'X' would not invalidate the sale.

Yes, I agree. No condition could be imposed on an owner of a property while disposing of the same.
