Hello
My Aunt and her brother signed a agreement in december 2010 for the participation of inheritage property.
And the the property which comes in share of my aunt according to the above agreement is occupied by tenants who use to pays the rent to the brother from last 4yrs after the death of their parents.
What is the best way to execute the agreement, so that the tenant starts paying the rent to my aunt and the property comes under her possession.

Whether the partition deed is regd.,? if not first register it. After the registration your aunt has to instruct the tenant to pay the rent to her.
On the basis of the partition deed your aunt will have absolute right over the property

make a clause in this regard in thr agreement and get registered the same. thereafter your aunt should give legal notice to the tenant to pay rent to her.

Sir, I have got it notarized by the autorized notary officer.
Now I don't think the brother will be ready to go to the registry office.
