Hi,
I have travelled from bangalore to chennai in a sleeper class where in most of the berths in my coach has dust of more than 1 inch on it,I have complained to Ticket collector and he has informed Commercial Control(bangalore). But nothing has happened. We had to clean it by ourself and fans were not working even.I have got the same confirmed with the attestation of the Ticket collector.
Now I would want to file case against the inconvinience caused.
Kindly Advice on how to proceed on this.
Thanks,
Praveen

When you purchase a ticket from the railway authorities you become a consumer. Therefore, the facility of transport provided by the railway authorities is a service under the Consumer Protection Act.
You can file a complaint to the consumer courts for any deficiency of service by the railway authorities. You also have a remedy under what is known as the Railway Claims Tribunal Act 1987 by means of an application. Section 13 of the Railway Claims Tribunal Act provides for compensation in case of a deficiency of service. However the scope of this act is rather limited.
You can appeal to the High Court against any decision of the Tribunal. The consumer courts serve to provide an additional remedy to the consumer.

When a tribunal is established, no other forum/court has the jurisdiction to conduct the cases coming under the jurisdiction of such tribunal. I think Praveen can approach the RCT.
