Guide me for Mobile theft law!

I found this forum right now.. this forum is awesome for the youth who didnt know the law. i hope u the only guys can help!

hello sir, my new nokia 5230 mobile was theft in my home last month(caused because of the opened door).So i went to police station. They simply didnt care about my complaint. anyhow, they asked me to come on the next day and they simply gave me the complaint receipt.

The name of the receipt they gave is "COMPLAINT PETITION ACCEPTION CERTIFICATE"

also he said, if he file the FIR, then their higher official will kick their xxxxx. like that he said. lol.

in that complaint receipt, it had mentioned that with in 2month, they ll take action for the complaint.

But i know its just a time pass and for convincing the people.

i called the nokia customercare and asked him to block my imei number. they said that that blocking facility is only in the western countries and not in india.
I know they r telling lie.

I planned to go to police station after 2month. Let me check what is their response.

But one of my friend asked me to go directly to the cyber crime branch. he said they can easily find the thief using the imei number.

Now my question is

1)what is my next move?
2) Shall i go to cyber crime division and provide this compaint receipt?

if they are not serious, then

3)Shall i apply for RTI for this?


please guide me..am waiting for ur reply.

There is no mobile theft law in my knowledge
RTI is applicable on the Public Authorities

oh one guy said that

If you have filed a police complaint giving IMEi nunber of your handset thenyou can file a RTI application to Police Station with following questions:
1.Whether Police Inspector in charge has requested the mobile operator(like Airtel,reliance etc.) to track your Mobile handset with IMEI No.? If not,the reason for it?
2.Whether reply from Operator received?
3.Total no. of mobile lost complaints filed during last year and whether any of the phone is found?

Now if u learn(through RTI reply) that certain cases of lost mobile has been attended to on priority, by Police , out of turn, you make next RTI query for the reason for ignoring your comlaint.


anyhow my question is shall we go to the cyber crime for this silly mobile theft?

orelse cybercrime is only for the online fraud, account phising like that???

Yes you may ask under RTI what steps has been taken on your complaint. You may also complaint to higher officials.

If you want to block your sim or using of your mobile instrument?

Blocking the sim is very easy by giving a complaint to the customer service.

For these type theft cases the police is not registering FIR, they will issue not traceable certificate after two months, If you have insurance you can claim it.

It has nothing to do with cyber crime.

But my suggestion is dont waste your time. buy a new phone or buy a used one. In the seconds market, Nokia 5230 is available for Rs.1300 to 1500.

but my friend said,

for these mobile theft, in kerala there is "HIGH TECH CELL" similar to "CYBER CRIME".

They r giving great response by recovering "the lost mobile using the imei" and giving great support such as individual website and forms for registering the complaint like that
where as in tamilnadu, we cant even find a proper district wise cybercrime division address. funny.

poor tn.

anyhow i wont waste my time for this poor mobile theft... but y i asked in this forum means they seems to be very lazy to do such work. because they said they dont even have computer in their station..

thats why i was disappointed and planned to have next step.

You state your case in details. Experts are not GUYS. IN future you address them as "Hon'ble Sirs". For your knowledge the Cyber Law is gradually becoming effective.

When the things are given free of cost, they are not worthwhile and when huge amount is in lieu of it then what a GREAT ADVICE.

In my career earlier I was giving free advices to my clients and they never responded back; but after opening my Law Firm I started taking money for every 15 minutes, now they say very good advice.

This is today's scenario.:)
