Transfer in Public Sector - Handicapped Employees / Employees having handicapped children

(Querist) 10 December 2010 This query is : Resolved
Dear Legal Experts,

Please tell me is there any legal protection against transfer for employees who are handicapped/ having handicapped dependents in Govt/ State Govt./ PSUs/ PSBs.

Whether such transfer is applicable only to Junior level officers for all category of employees?

Which is the right forum to address such transfers as the employer do not consider the request sympathetically?
Advocate. Arunagiri (Expert) 10 December 2010
For every Public officers, the transfer is common. If they have any specific grievance or need they can address to their superior authority, against the transfer.

As a general rule they can be transferred. On special cases the transfer orders can be canceled. If the immediate superior is not considering, apply to the next level.
Arunagiri (Querist) 11 December 2010
The application for request of transfer on sympathetic grounds was placed before the topmost authority of the organisation. But no reply/ consideration has been received. Now tell me what to do?
