My father left a registered will from haryana in my favour.I got some agricultural land in HR & a house in Delhi.There's a court case with with the shop tenant at delhi's house.I want to transfer the house on my name, what's it's procedure, is it necessary to probate the will for this.I have three more sister's, one of them is married.The delhi house is my father's earned property. what's the fees for probating the will.In what ways it is useful to me.

You have to get the will probated. You ask what is the use of probating the will. By getting the will probated you will get the stamp of approval from Court. Without probate, if some one objects to the validity of the will, you will have problem in enjoying the property. (Even while you are seeking probate, other interested parties may object, but the court will decide upon their objections.)

Probate is unnecessary. The recent amendment to the Indian Succession Act has done away with the need for probating the wills.

This amendment is not applicable in every state. In West Bengal it is still mandatory to take probate of the Will.
