if the defendant did the breach of contract but anticipatory breach due price increase of the commodity he had 2 sell,due to union budget by the govt. provided he returned the advance money....before the decided date.... also the present date was re decided by the plaintiff by word of mouth....because of a natural calamity.....he had to renew the previous date....... how can we save the defendant from any loss......

Is there any agreement in respect of the price variation due to increase in the prices of the commodity? If there is a condition in the agreement then defendant will survive.

Every thing should be mentioned in the written agreement. If there is a clause regarding the prices, definately you can save your client. No oral or mouth words be entertained in the court of law regarding the contract.
