Prime Minister's Appeal

Our PM has made an Appeal to the public in all news papers regarding the proposed verdict by High Court on Babri Masjid case. Does it not amount interference of Executive over Judiciary process in the country? Experts to please enlighten and correct me If I am wrong.

Dear Sir,
I appreciate your concern. But the PM did not say which way the Court Decision will be. On the contrary, being the PM, and given the communal tension that prevailing and also the verdict may generate one way or the other, he has made appeal to all to maintain calm and peace. I do not think it is in any manner any interference by the Executive in the Judicial process.

I pray that such appeals do not create any panic or apprehensions on the minds of the common man before the verdict is pronounced. After all, it is the duty of the Executive to have its fullest control over law and order in the society and PM cannot voice it beforehand.

Dear Mr.Loganathan,

Our PM has made that statement on the basis of the resolution passed in the cabinet meeting.There is nothing wrong in it since he is primarily responsible for the upkeep of national integration .His burden is much more than that of the judiciary in the matter.

Maintenance of law & order is an executive matter & the judiciary has nothing to do with that.The PM is well within his rights to appeal & to my mind, he has done the right thing.

That is exactly I pointed out. Being the Head of the Executive it goes without saying that he has the ultimate responsibility over the law and order issues. But since the verdict is in the pipeline and though the statement is on the basis of resolution passed in the cabinet meeting such appeals are not warranted. It could have simply been one of the news item. I thank our experts Mr. Ramachandran and Mr.S.Subramanian for their opinion.

As head of the Political Executive Our PM did the right thing. Nothing in it to make it an issue out of it.If a clobber make such an appeal, how will you react?

There are certain issues which should be tackle without politicizing it. As for example the case of Kesavananda's case, which was nearly reviewed by the full court, which would have resulted in revolution in the Country, so is the latest SC ruling on adverse possession? SC did the right thing on adverse possession, and we should not politicize it, but give a serious thought on it. Let us always keep the interest of the Nation first and not politics.

Such Appeal before the judgement may influence the judiciary in some subtle manner and thus, such decision of the Cabinet need not have been so publicised
