You may file both civil and criminal cases.

you have to choose only a proceeding that can give permanent relief. criminal courts cannot set aside a frausl;ent partition that has already taken place. only a civil courtcan examine the fraudulent nature of the partition and declare the same tyo be void and illegal. hence go in for that relief.
